Terms of Service

These terms govern your use of this website and of the services of ATIKO APP LLC, a New Mexico limited liability company (Entity ID 0008130756), 15 Tanguay Ave, 112 #2d, Nashua, New Hampshire 03063, United States ("Atiko", "we").

What we do

Atiko is a business filing and administrative assistance service for e-commerce businesses. At your direction and using the information you provide, we help you, step by step, to: prepare and file company-formation documents with the relevant state authority; apply for a tax identification number (EIN); complete your own applications for bank accounts and payment-provider accounts; and keep track of renewals and recurring administrative formalities.

Our role is clerical and administrative. You decide which type of entity to form, in which state, and how to run and tax your business. Documents such as operating agreements are standard templates, not documents drafted for your specific situation.

What we are not

Atiko is not a law firm and not an accounting firm. Our staff are not attorneys, certified public accountants or tax advisers. We do not provide legal, tax, accounting or financial advice, and nothing on this website or in our communications should be taken as such. Using our services does not create an attorney-client or accountant-client relationship, and our services are not a substitute for the advice of a licensed professional. General information we share about how formation or account opening works is information only.

Atiko is not a bank or a payment institution. We do not hold, receive or transmit client funds. Bank accounts and payment processing are provided by independent institutions under their own terms, and you are the applicant and account holder. Atiko is not affiliated with, or endorsed by, Stripe or Shopify.

Independent professionals

Where bookkeeping, tax filings or legal work are needed, they are performed by independent licensed professionals. They act under their own responsibility and their own engagement terms with you. Atiko may introduce you to them and coordinate documents, but does not perform, supervise or guarantee their work.

Your responsibility

You are responsible for the choices you make about your company, for the accuracy of what is filed in your name, and for meeting your legal and tax obligations in the United States and in your country of residence. We recommend that you consult a licensed attorney and a tax adviser before forming a company.

Eligibility

  • You must be at least 18 and act in your own name or for a company you lawfully represent.
  • You must not be resident in, or acting for a person or entity located in, a country or territory subject to comprehensive sanctions, nor appear on any sanctions list of the United States, the United Kingdom, the European Union or the United Nations.
  • Your business must be lawful and comply with the acceptable-use rules of the banks and payment providers you apply to.

We may refuse or end the service at any time if these conditions are not met or cannot be verified.

Your obligations

You agree to provide complete, accurate and genuine information and documents, to tell us promptly of any change, and not to use the service to conceal identity or ownership, to evade taxes or sanctions, or for any unlawful purpose.

No guarantee of approval

Every bank-account and payment-provider application is decided by that institution alone. We cannot guarantee that an account will be opened, kept open, or opened within a given time. Timeframes shown on this website (such as 24 hours for a company and one week for bank accounts) are typical targets counted from receipt of a complete file, not commitments.

Fees

Fees are described in the Billing Terms and confirmed in writing before you pay.

Liability

To the extent permitted by law, Atiko is not liable for decisions, delays, freezes, closures or fees of third-party institutions, nor for indirect or consequential losses. Our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing excludes liability that cannot be excluded by law.

Termination

You may end the service by written notice as set out in the Billing Terms. We may suspend or end it immediately if you breach these terms or if required by law.

Governing law

These terms are governed by the laws of the State of New Mexico, United States. The courts of New Mexico have jurisdiction, without prejudice to mandatory consumer rights in your country of residence.
